The Ministry of Labor and Social Security has announced new requirements for employers applying for work permits for third-country nationals. Starting February 25, 2025, employers will be required to submit a security deposit of 250 euros and provide a notarized undertaking. This regulation is based on Article 34 of the Regulation on Work Permits for Foreigners under Law No. 63/2006.
Key Changes in the Application Process:
- Security Deposit: All work permit applications for third-country nationals must now include a 250-euro deposit as a guarantee.
- Notarized Undertaking: Employers must download a sample undertaking from the official Ministry portal (csgb.gov.ct.tr), complete it, have it notarized, and submit it to the Ministry. The document must include details about employment and the potential repatriation of the worker in case of contract termination.
- Document Submission Process: The notarized undertaking must be uploaded to the online system, and the original document must be submitted in person to the Ministry.
- Consequences of Non-Compliance: Employers who fail to comply with the undertaking conditions will be prohibited from submitting new work permit applications for third-country nationals for one year.
- Adjustment for Previously Submitted Applications: Applications submitted before February 24, 2025, that are still under review will have their guarantee amount automatically adjusted to 250 euros.
- Previously Approved Applications: Work permits approved before February 24, 2025, with already uploaded guarantees, will remain valid and will not be canceled.
These changes aim to enhance employer accountability and provide financial security related to the employment and potential repatriation of foreign workers. The Ministry urges employers to comply with the new requirements promptly to avoid delays or rejections in their work permit applications.
